Neither one of them is doing cobra since the pubic bone is not rooted into the floor and the knees are off the ground for both dog and poorly shopped tv guy. Also, while you can optionally keep your toes tucked for upward dog, you can not for cobra pose.

Well, the yoga instructor appears to be doing cobra all except the toes (and possibly pelvis, hard to tell?), but that isn't upward dog either. Your toes should be laying on the ground in both poses.
