Rules

  1. No screenshots, or pictures with added or superimposed text. This includes image macros, comics, info-graphics and most diagrams. Text (e.g. a URL) serving to credit the original author is exempt.

  2. No gore or porn. NSFW content must be tagged.

  3. No personal information. This includes anything hosted on Facebook's servers, as they can be traced to the original account holder. Stalking & harassment will not be tolerated.

  4. No solicitation of votes (including "cake day" posts), posts with their sole purpose being to communicate with another redditor, or [FIXED] posts. DAE posts go in /r/DoesAnybodyElse. "Fixed" posts should be added as a comment to the original image.

  5. Submissions must link directly to a specific image file or to an image hosting website with minimal ads. We do not allow blog hosting of images ("blogspam"), but links to albums on image hosting websites are okay. URL shorteners are prohibited.

  • If your submission appears to be filtered but definitely meets the above rules, please send us a message with a link to the comments section of your post (not a direct link to the image). Don't delete it as that just makes the filter hate you!

  • If you come across any rule violations, please report the submission or message the mods and one of us will remove it!

Please also try to come up with original post titles. Submissions that use certain clichés/memes will be automatically tagged with a warning.

Er, I'm no iPhone defender--actually I kind of hate the iPhone--but the examples here demonstrate release dates, not patent dates.

Also the release dates are kind of silly:

  • The first PDA with a grid of icons was the Newton.
  • The notification bar wasn't in question in any lawsuits, neither was slide to unlock or split keyboard or whatever.
  • The picture of the F700 is a lie, it was announced after the iPhone.
  • Siri wasn't invented by Apple is was part of a Darpa project long long before Xaio Bot or whatever. Apple just bought it.

That being said Apple's lawsuits are bad for everyone but Apple. The trade dress bit makes sense, but I don't think anyone is honestly confusing things for the iPhone.

Everyone always seems to forget that the F700 was shown at a trade show several months before the iPhone announcement and launch. It was in R&D at the same time as the iPhone and launched after it.

That was from its launch in Feb 2007. It was announced at Cebit 2006, though not actually demonstrated, working hardware, etc.

I agree, but its ridiculous that the patent system allows someone to patent something they didn't invent, and then sue the creators. that's what bugs me.

That is not what the patent system does. If you can prove that someone else invented it you can invalidate a patent. The problem is that people don't understand what is being patented and how it is being infringed on.

I don't mean to come off like a dick, but if you invent it and don't patent it, you kind of have it coming to you. Let this be a lesson to everyone that laws are serious business. If you create something, get the rights to it. A friend of mine wrote a song which was picked up by a Grammy award winning artist and put on their album which ended up winning the award. You know what he saw from that? $0. His fault, though. He didn't play by the rules. Shitty? Oh fuck yes! He deserves the cash for it, but he'll never see it because he didn't properly copyright the tune and register it with ASCAP and/or BMI.

edit: Oops, I just checked, and they didn't win the Grammy, they were just nominated for it; and it was for the album they released one year BEFORE the album with my friend's song on it. Next time I will look this all up before I post.

The patent system is not supposed to allow patenting of prior art, so your point is bullshit. The rules were not being followed when Apple was granted those patents.

Patent dates and release dates are not the same thing, dawg. If Apple patented something and Samsung rushed a product to market that violated those patents, they are... in violation. I rather think your point is bullshit. If someone can demonstrate legit prior art, then let them. So far, the courts seem to think it hasn't happened. Certainly I disagree with the court on a couple points, but all in all, if you don't patent your shit and someone else beats you to the patent office, that's your problem.

prior art doesn't need to be on the market. In fact, there doesn't even need to be a product. if something is obvious to an engineer in a field, it should not be patent-able. The current US patent system favors aggressive patenting because the provisions that let you challenge patents assume the patent examiners did a decent job, which they clearly don't. Also, the "courts" you are talking about are jurors with no technological or patent expertise. They have decided a variety of different things in apple vs samsung cases.

I don't disagree, but bitching about the system isn't helping. If you want to fix the patent system, then cool, fix it. Complaining that Company X made a product first is pointless. The patent date is the issue, not the release date. That's all I'm saying. I'm not arguing that the patent system isn't stupid.

As someone who owns both iOS and Android devices, they both are great platforms. The real shame here is that we are taking sides with either Apple or Samsung, Google, Motorola etc. when really they are all (mostly Apple though) only hurting the consumer, which is us.

I don't cheer for the products. I do jeer when Apple (and others) abuse the legal system in ways that hurt consumers, to benefit their bottom line.

All of the tech companies are involved with these lawsuits. They really need to learn a lesson from the early years of the aviation industry which was stagnated by the patent system until Congress knocked some sense into them for the sake of national defence.
