If you watch it closely he has to jump out from behind the other car because the SUV runs into the back of the stopped car. Watch as his mate jumps into the boot of the stopped car and you'll see why he didn't wanna stay there. But yeah, it was definitely the driver's fault; you don't go that fast past a stopped car in the middle of a fuckin' freeway.

You also leave enough stopping distance so you don't have to swerve around a car that performs an emergency stop in front of you.

I believe the fault goes to those who stopped in the MIDDLE of the freeway, but of course the driver who hit the guy will see some consequences..
