It depends if the case goes before a grand jury. Jurors don't think straight when they see a kid in a wheelchair. Unless his parents were the one's filming, they could probably argue that it was mall security's job to keep people from screwing around like that, and they failed to stop him from doing that. Therefore, he got injured by the negligence of mall staff. Yeah.
