In case you're wondering what's going on here, this is what it's all about. Funnyjunk steals Oatmeal's comics, Oatmeal asks them to stop, Funnyjunk thinks lawsuit is appropriate. This is TheOatmeal's response.

Essentially, here's a quick point-for-point rundown of the whole thing, a drawn out "TL:DR" if you will.

  • Funnyjunk hires Charles Carreon, a lawyer with a name-fitting play on the word "carrion," who specializes in online law.

CC sends letter to TheOatmeal stating several grievances; Presented here to you in summarized bullet-points.

  • He accuses TheOatmeal of slander in a previous post where TheOatmeal outlines funnyjunk's "business plan" which accuses them of copying and rebranding artists' original works, saying "our users uploaded it, we have no control!" then profiting on ads. CC thinks this is grossly exaggerated and they act promptly on DMCA complaints.

  • TheOatmeal counters with a list including hundreds of active links where his site's information is cropped out or removed, posted to funnyjunk. They have since been removed.

  • CC then accuses TheOatmeal of loading null hyperlinks so that TheOatmeal comes up in google search when someone searches for Funnyjunk.

  • TheOatmeal points out why that's absolute bullshit.

  • CC accuses him with making false statements with malicious purpose because of an ASCII pterodactyl on TheOatmeal that's been there since 2009.

  • There are few ways to describe just how 'epic fail' that is, but TheOatmeal sums it up nicely by pointing out it existed far before the issue at hand. With evidence, to boot.

  • Charles Carreon demands $20,000 USD and all mention of Funnyjunk be taken off TheOatmeal by June 12, 2012.

  • TheOatmeal counters by offering to send him a picture of his mom seducing a bear, and a picture of all the money he raised for charity as a gentlman's "fuck you."

Further insight by ajw827

  1. They have no defamation case because, although they tried to delete everything, cached pages show they did steal from Oatmeal tons of times as recently as May 23, 2012, so the required element of false allegations in a defamation suit do not exist.

  2. As a lawyer on Oatmeal's FB pointed out, including link to actual statute, demanding $20K to avoid the suit could be possible extortion by Funnyjunk.

  3. Oatmeal made them look super foolish, tons of media outlets have run the story, almost all concluding Funnyjunk has no case and made themselves look like fools.

  4. The fact that Oatmeal has turned this into tons of dough for charities makes them look awesome, which probably was not what Funnyjunk had in mind.

It's not just about donating time. I'm not a lawyer myself, but my understanding is that some need to take cases pro-bono in order to gain legitimacy or experience so that later on they have the cred to take on bigger and better paying cases.

If I was in this position I would see this as an easy win for my resume.

There's no such thing as an easy win in court. You will have to hire a lawyer and pay court fees. Since it's the U.S. it's very difficult to recover legal costs and they'll come out of whatever damage award you get. So now you're in court; even if you get a Judge who understands concepts like null hyperlinks and cached google search results judges will often do whatever they feel like in an effort to resolve things as opposed to applying the rote letter of the law.

Besides, what are the Oatmeal's tangible monetary damages here? I'd argue that he hasn't suffered any damage and at this point has been enriched by the whole thing.

If he is being extorted he should contact the police and bring charges under the criminal code. Threatening a lawsuit is generally not considered extortion. The Canadian criminal code (I'm Canadian so that's what I know) explicitly states that a threat to bring a civil law suit does not count as extortion.

Here's the way to read his letter:
You have caused me damage. Here is a detailed listing of the things you are done which have caused me damage. I estimate that I have suffered $20,000.00 worth of damage. I believe this for the following reasons. Please compensate me for my damages or I will sue you.

That's not extortion. Extortion is more like: "Pay me $20,000 or I'll break your fucking legs".

IANAL but procedures and laws of what can be used as evidence in civil court are a lot more complicated than just bringing in a laptop and/or printing out a Google cached link. It may involve a subpoena to get data from Google and/or have a Google "expert witness" testify... things that can cost a boat-load of cash up front. Any sort of "your user posted this" could potentially be objected to due to hearsay.

All I'm saying is that as much BS as this is, The Oatmeal really should consider taking this very seriously, and perhaps taking donations for a legal fund rather than charity (and then donate the compensation to charity after the case is settled).

The main difference in this specific case is probably that Funnyjunk went to great lengths to remove watermarks and site/author information, and essentially tried to label it as their own.

A Redditor who uploads a "saved as" image of a C&H comic to imgur isn't hiding the authorship and profiting from reposting the info. They get imaginary internet points. Funnyjunk gets ad hits and has deliberately tried to mask the OC's author.

If a redditor posted it as "hey, look at this comic I drew!" and manipulated the image then hosted it on their own blog that either was pay-to-read or supported by ad revenue, they would be called asshats and rightfully attacked by mobs with pitchforks and torches.

Now imagine if that redditor sent a letter to C&H demanding money and that C&H stop badmouthing them :P

That's what's happening to Funnyjunk right now.

I see this as just one more sign of his mental state -- that he could not focus enough to catch this error OR proofread it.

Why can't he? I think that was the original plan, after it clears his bank, withdraw it, take a picture, and deposit it again for donating.

I understand the bank might bitch about the amount, especially now that it's growing this fast, and might not be able to meet his demand without notice, but I would imagine if he calls in advance, explains the full story to the bank, and makes sure they know it's for charity, they can probably arrange for some photographs with the right amount of money without him having to risk taking it all home and going back with it. I've done contracted I.T. work in bank vault facilities where people worked around pallets of $100's that were worth hundreds of millions per pallet. A million in hundreds takes up a surprisingly small amount of space, it fits in a plastic grocery bag.

He might actually want to request a smaller denomination if he want's the amount to be as impressive to the eye as it is to the brain.

Most likely won't happen. People don't normally just withdraw 100k from the bank. If you want that much money to move you'll get a certified check or have the bank transfer it for you.

Most small branches won't have that much to give out and if they do it will completely wipe out their cash reserves. They will do anything to not make that happen.

I know this. The reason why I said "self-proclaimed 'lawyer'" was because she listed herself as a lawyer (I believe in Texas), but did not appear in any iteration of the state's bar list (which is publicly available).

Libel isn't just about publishing something hurtful, otherwise negative campaign ads and editorials would be libel. It's also not about being wrong, because then 99% of the internet would be liable. It's about maliciously lying with intent.

It looks like TheOatmeal actually covered themselves nicely by providing the facts behind their past statements before launching their counter offensive. I can't imagine any judge that would let this case proceed, and I -can- imagine several that would call the lawyer onto the carpet for what even an "uneducated" person can see is an extortion attempt via the legal system.

Okay so I went there for science. I have never been to FJ before and now my eyes are burning and I think I've lost some brain matter through ear leakage. But to answer your question the top rated pic is a screen cap of the first page of the The Oatmeal's rebuttal to FJ suing them.

I tried to read some of the comments but I felt more than a little queasy and passed out for a few minutes from the neon barrage of color and the absolute clusterfuck of ads on their site (no I don't have adblock on this computer but it's downloading now). What I did gather is that most of the commenters have had intercourse with Matthew Inman's mom, and that you are somehow mentally deficient if you side with TheOatmeal.

They are text filter thingies. He usually goes by 'Admin', but he regularly replaces it with stupid things like that.

Basically, if you type 'Admin' or 'admin' in a comment, when you post it it will automatically change. There are a lot of other words like that, too. It's very annoying, and that's why you'll see a lot of people typing the words strangely to get around the filters.

Oh, yeah. Admin's a complete douchebag that doesn't care about his userbase and insults them on a sometimes daily basis. I refuse to give him any traffic ever again.
