I knew I recognized that name! Its from my city. Saint John houses are usually assumed to be haunted unless otherwise stated by the realtor.

During a real estate transaction you may ask the Seller if the house has a history of being haunted but they are not legally obligated to tell you unless you present the question in writing.

Well, they wouldn't even say 'no' they'd just say "I can't divulge that information of behalf of my client." And since its 2012 we usually just email each other with our smartphones while standing next to one another.

Interestingly, there's an entire industry that works on dehaunting homes as part of the inspection and repair process of a home sale.

Essentially, the seller had claimed that the house was haunted, and it was featured in Readers Digest and a local newspaper as such, but didn't disclose this to buyers. The potential buyer had placed a $32,500 deposit on the house before they learned of this, and as a result wanted the contract rescinded (i.e. torn up) and their deposit returned. The court agreed that the seller was estopped (i.e. required to) disclose this fact, and sided with the potential buyer.

Here is the good part:

While I agree with Supreme Court that the real estate broker, as agent for the seller, is under no duty to disclose to a potential buyer the phantasmal reputation of the premises and that, in his pursuit of a legal remedy for fraudulent misrepresentation against the seller, plaintiff hasn't a ghost of a chance, I am nevertheless moved by the spirit of equity to allow the buyer to seek rescission of the contract of sale and recovery of his down payment. New York law fails to recognize any remedy for damages incurred as a result of the seller's mere si- lence, applying instead the strict rule of caveat emptor. Therefore, the theoretical basis for granting relief, even under the extraordinary facts of this case, is elusive if not ephemeral. *257

It portends that the prudent attorney will establish an escrow account lest the subject of the transaction come back to haunt him and his client--or pray that his malpractice insurance coverage extends to su- pernatural disasters. In the interest of avoiding such untenable consequences, the notion that a haunting is a condition which can and should be ascertained upon reasonable inspection of the premises is a hobgoblin which should be exorcised from the body of legal precedent and laid quietly to rest.

This can be true in certain scenarios. An excellent example is a house in Savannah, GA, which markets different hauntings in effort to increase its tourism. In particular, the house that was the focus of the movie Midnight in the Garden of Good and Evil is still owned by the Williams family, but many people offer large amounts of money for the house itself. While its obvious connection to the books and movies doesn't make it the best example, other houses have similar stories of potential buyers wanting houses that may not even be for sale. On the other hand, outside these tourism areas, we had a house with a double murder not sell for a very long time due to suspicion. Eventually it did sell, but under market price.

A person I used to work with is a real estate agent. She told me in Tennessee they have actual house haunting laws that apply to real estate dealings there. I laughed at this, but she took it very seriously.
