Honestly, I'm not convinced that that's a good excuse. People with Down syndrome still need to learn to behave themselves in a civilized society. How much intelligence do you need to understand that?

To put things in perspective, how intelligent is a dog? We expect dogs to not behave violently, and a large majority of them don't. Is this person really less intelligent than a dog?

Edit: Granted, I think the punch was way too much. The kid wasn't even moved by the force of the kick, and he didn't appear to be in any pain. If I were the parent, I would have just pushed him.

I agree. Being mentally handicapped does not give you a free pass to kick children, period, regardless of how hard he kicked. If you cannot be trusted to behave, your caretakers should not take you out in public.

Besides, I would think that even a mentally handicapped person would be able to learn very quickly that certain behavior will get you beat down.

I can see all the handicapped apologists shaking their heads and wringing their hands right now. Too bad. I hope the dad kept beating him until there were enough people to pull him off. I'll bet he doesn't kick at another kid anytime soon.

So after seeing this a while back and learning the guy was mentally handicapped I have to wonder if this sort of reaction changed his behavior in any way in the future. Like, would he be less likely to kick some kid down the road?

Just wondering. I personally think this is a toughie. If you kick a kid you sort of deserve to get knocked out. At the same time this guy probably doesn't control his actions well and doesn't understand things the same way 'we' would, so it's not really fair to judge him the same.

What is the law on this sort of thing?

If you see someone across the street kick your kid, and then walk away, can you get arrested for punching him? What if they hit your wife? Where is the line drawn between it's okay to retaliate and when it's not?

Serious question, the way I understand the law the guy getting punched could press charges (could be wrong).

Don't remember exactly, have seen this before and then someone found the newspaper report of it.

The lady behind the man who kicked is his guardian and helper. He got annoyed when the kid screamed and jumped when he was talking on the phone and didn't know any better then to not kick him. The fault really is the ladys not looking after him better.

The father did the right thing, he apologized after I think when he found out the kicker was mentally handicapped.

None of that makes any sense. Please research mental disabilities more, I don't find any connection of him having a phone to anything. Nor do I understand the point of where he learned it was okay to kick; he does not understand that it is not okay to kick. I don't know what you think the mental capacity of someone with a disability is, but it is not like you or me. And any ability to operate a cell phone has no bearing on it at all.

Don't directly blame people who take care of them, you have certainly not been with people with down syndrome. I often hear people telling "Oh he should understand" imagine a child where you tell him 10 times 20 times 30 times 1000 times something and you have to tell it over and over again to get 1% improvement in the behaviour of the kid because he stays at the same mental stage during years and years, it's harassing mentally and physically.

Some other people with down syndrome do much better and understand how things works and sometimes can be independent but that's not the majority of people with down syndrome.

If you wonder my brother has down syndrome I'm speaking from experience here.

But having also had some exposure to children with Down's syndrome (granted, not as much as you; a neighbor kids down the street who we all included), and they don't usually just lash out like that either, do they? Where would he ever get the idea that you should kick anyone, is my question to the caregiver?

It's an unfortunate incident, but as a father, I'd be hard-pressed not to understand that man's reaction to someone, anyone, assaulting his young child. Down's or not.

Yes sometimes they do, every kid is really different and reacts differently to each situation : sometimes it's just for trying to play but act wrongly, some don't realise how much strength they have.

Some kick sometimes just because something was wrong or wanted to play but for most of them as soon as they realise what they did was wrong they'll apologise and come to you to cuddle.

You may ask me where the kicking may come from, look at a kid, do you have ever asked yourself the question where they have seen people kick other people and do the same? Because that's what children do, often because they see it on TV with cartoons for example, but the child will be able to learn and evolve and not stay in the stage "kicking things is cool" but the guy with down syndrome will not.

Basically you keep on being with a child.

If I remember correctly, the guy who kicked the kid has Down's. But, the dad who punched him was a burglar. But the Down's guy also set fire to a forest. But, the dad voted for Bush...twice! But the Down's guy saved a box of full of kittens from drowning. But, the dad had a warrant for domestic abuse.

This video was from 20 years ago and the kid grew up to take PCP and bite some guy's face off. Could've started from getting kicked by a grown man. Or maybe the Down's guy was trying to stop him so very long ago.
