I don't think he's dead.

Most likely broke at least one of his legs, though. (Although he seemed to still be able to pull them into fetus position as a reflex of getting hit so most likely no permanent damage.)

Also, just about everyone involved is at fault. Cars should be pulled over, specifically to avoid something like this. Driver should not be driving like an asshole, specifically to avoid something like this.

These people were visible way before he got near them. He's a complete idiot.

If these people at least attempted to take precaution and it was a technical error on the part of the car then I would say both, the person in the cross country vehicle and the person drying the black car that wasn't keeping the necessary safety distance for his/her speed, were at fault for driving recklessly.

If the people around the car didn't attempt to take necessary precautions or weren't injured or were the ones who cause the situation in the first place, then they are at fault.

Both cars appear drivable, which lead to my comment. Your first priority should always be to move the car. I've always heard "If you can steer it, clear it." In some places you can even be ticketed for not moving an operable vehicle on top of whatever else that may have caused you to stop. On top of that, they are in the middle lane of a freeway, probably the single most dangerous place you could step out of a vehicle.

Both cars were driving recklessly, true. They are assuredly more at-fault than the others. I'll never understand why some people have such a distaste for applying breaks. I'm always seeing people pull this maneuver and swerve around cars rather than just applying the breaks. Quite a dangerous habit.

I was in such a situation only once.

A guy tried to pull into a busy street right in front of me. I pressed on the brakes as hard as I could and pulled sideways. It's not like the car can come to an immediate halt. It's also simply a reflex.

How would you know the other guy got injured?

He obviously reacted, turned around and tried to jump into the trunk, which also is very likely to have worked considering the car wasn't pushed forward very much.
