Legal implications: Although the shooter may have the thought the gun unloaded, threatening another with a firearm is at the very least negligent enough to warrant negligent homicide, and depending on the jurisdiction enough a crime to be a felony. If the threat is felony, that charge could be upped to felony-murder despite the fact the victim was in the process committing suicide.

It would be a felony, as it would construe domestice violence with a weapon, which under most state laws is a class C felony.

We had this case presented to us as a exercise in my Criminal Law classes. Most people went for the circular bit, but those of us who had paid attention stopped with the elderly man and immediately charged him with DV, Menacing, and Discharging a Firearm within City Limits. The whole thing is just a mental exercise.

.... it was 8 paragraphs, and, according to snopes was created as an anecdotal (do you need a tl;dr for that word?) example of how minute (that means small and is not a measure of time) details can change the investigation and impact the conclusions. Fake or not it was both funny and informative.

How does one function in the world (or on the internet) if they're unwilling to read a single page of magazine text???
