From the US passport website:

Photographs for passports (or we assume other official documents?) must be...

Taken in clothing that you normally wear on a daily basis: Uniforms should not be worn in your photo, except religious clothing that is worn daily. Do not wear a hat or head covering that obscures the hair or hairline, unless worn daily for a religious purpose. Your full face must be visible, and the head covering must not cast any shadows on your face. Headphones, wireless hands-free devices or similar items are not acceptable in your photo.

If you can prove it or act convincingly, they technically have to let you. But we're talking about the US government here, so I assume they can use their subjective judgment even if it isn't empirically any worse or better than a real religious head-covering.

This law DOES NOT APPLY to photo ID issued by the 50 individual states. Those laws will vary from state to state.

I don't know about the other 49 states, but Pennsylvania doesn't give a fuck about headgear. I've had a ball cap in every license I've ever received from the state. Never once did the guy at the DMV say anything to me either.

My cousin in Minnesota had her driver's license photo taken wearing a tiara and princess gown. (Yeah, she's hilarious.) So, I don't think they really enforce that rule in most places.

It'd be an interesting exercise to see if they allowed it when you claim it in the name of the Flying Spaghetti Monster though. (May his noodly appendages cover you in sauce today. Ramen.)

You could bring in some pics of you doing things with the colander on your head. Riding a bike, playing football, posing for photos, shaking hands with someone legit looking, etc.

What does "worn daily" mean though? Does it mean worn all day every day, or just worn at one time every day? For example, I shit daily - but I only do it once a day for 5, er 10, minutes. So wearing your sieve "daily" may be as simple as putting it on your head for 5 minutes.

Essentially. They want the photo to match the person standing in front of them.

If you have a colander on your head in your passport photo, the TSA agent checking your passport is going to expect to see you wearing it.

I find no reason why lying for something as harmless as wearing a pasta strainer is morally bad. There's no ultimate harm to others by this lie is there?

It's not something they're going to rigidly enforce if it looks like a religious head-covering. As it stands, at least in my state, you are perfectly welcome to pose for important photographs wearing a full Hijab or anything less (Kippah, etc). I have personally watched a woman wearing a Hijab pose for her drivers license photo. They didn't ask her if she wore it every day. It's just a categorical.

Technically speaking, if you can argue for the strainer with a straight face and you don't care about the laughs you'll get when people see your photo... go for it! This is a bold step in doing something that really shouldn't be all that absurd.

Most states provide for religious/cultural exemptions
Thirty-five states exempt religious or cultural headgear from the requirement to expose the hair. These states are:

Alabama, Alaska, Arizona, California, Colorado, Connecticut, Florida, Hawaii, Idaho, Illinois, Indiana, Iowa, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Nebraska, Nevada, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Vermont, West Virginia, Wisconsin, and Wyoming.

Some state recognize religious headgear as normal wear
Minnesota, New Jersey, New York, Texas, Utah, Virginia, and Washington do not view religious headwear as as exception that need to be addressed, but as a normal variation that is recognized and respected.

Several states are silent on the issue
Georgia, Kansas, Kentucky, and New Hampshire do not have laws or regulations regarding headgear in drivers license photos.

Hey, I saw this picture a while ago, and it inspired me. My high school bans hats, unless it's religious headgear. I came to school wearing a colander, got a detention, talked to the LEADERS of the school, and convinced them that I like to wear my colander on Fridays, to praise FSM. I printed out the 'About' section of the Church of the FSM website, to describe to them that my religion is a real, serious thing. BAM! Detention revoked, several people at my school wear colanders at school on Friday.

It's a fake... It was all over the news in Austria. He used the noodle thingie as a hat on a picture for his driving licence and stated that it's because of religious freedom. Thing is: You can wear any hat you want on pictures for the driving licence. They wouldn't have let him do it if it was a passport photo.
