[–]my_name_is_stupid 109 points110 points ago

They even have a disclaimer in the commercial saying "yes, the money's expensive, but you get it fast!".

When the person trying to give you a shitty loan feels compelled to acknowledge its shittiness, stay the hell away.

[–]Sasken 19 points20 points ago

sorry, this has been archived and can no longer be voted on

I'm guessing there's a legal requirement for them to say that, otherwise they wouldn't be doing so.

[–]resutidder 34 points35 points ago

sorry, this has been archived and can no longer be voted on

The legal requirement for interest rates are "do not charge 30 percent or more or we will prosecute you for being the Mafia." Hence, the 29.9% interest rate.

Now, this is the rule as it applies to the United States. Native American territory rules are a little different. I'm gonna go out on a limb here and guess that the teepee logo and the attractive with tribal earrings aren't a coincidence.

[–]bigroblee 36 points37 points ago

sorry, this has been archived and can no longer be voted on

Along with the part in the ad where it clearly states "Western Sky Financial, LLC, is a 100% Native American-owned business operating on a Native American Reservation". I actually got interested (not in taking a loan, but in the terms) and found they include this little gem;

All borrowers must consent to be bound to the jurisdiction of the Cheyenne River Sioux Tribal Court, and further agree that no other state or federal law or regulation shall apply to this Loan Agreement, its enforcement or interpretation.

Hell, not all tribes can open casinos, and we sure as hell fucked them pretty well and good for years. I don't oppose this; just another tax on stupid.

[–]Quajek 38 points39 points ago

sorry, this has been archived and can no longer be voted on

So what you're saying is, I can get $5000 for free and all I have to do is continue the time-honored American tradition of breaking treaties with Native Americans?

I can do that!

[–]AtomicSamuraiCyborg 0 points1 point ago

sorry, this has been archived and can no longer be voted on

Now, that sounds like a great idea. How much authority do tribal courts have over US citizens who reside in other states?

Also, they probably wouldn't loan to you in that case.

IIRC reservation lands are sovereign territories that abide by their rules/laws. The loan business has been really big for these people since they can set the interest rate to whatever they feel like. There's been reports of 600% rates. I can't imagine ever needing 500usd so badly that I'd be willing to pay thousands on the back end. But then, I'm not poor so ...

[–]jrugerstein 2 points3 points ago

sorry, this has been archived and can no longer be voted on

This isn't exactly true for all types of interest. Title loans, for example, can easily be above 100%. From Wikipedia: "Depending on the state where the lender is located, interest rates may range from 36% to well over 100%."

Basically, the more dire your straits, the more horrendous the rate.

[–]AtomicSamuraiCyborg 1 point2 points ago

sorry, this has been archived and can no longer be voted on

Yay capitalism.

[–]samferrara 7 points8 points ago

sorry, this has been archived and can no longer be voted on

Wouldn't that require some legal definition of "expensive" that would be hard to set? I've seen the commercial, and she says it kind of casually but matter-of-factly, and I think it's an attempt to legitimize what amounts to an obvious scam/rip-off.

[–]studmuffffffin 2 points3 points ago

sorry, this has been archived and can no longer be voted on

Expensive seems like a subjective term. I doubt they have to say it.

[–]dustinjt 64 points65 points ago

[–]FSU_Fan2004 27 points28 points ago

sorry, this has been archived and can no longer be voted on

I have no idea, but I'm hoping this is only legal because they're operating on a Native American Reservation.

[–]labrutued 22 points23 points ago

sorry, this has been archived and can no longer be voted on

For some reason it's legal because they're not a bank. Don't ask my how that works as it seems like the same logic as saying, "You can't sue me for malpractice; I'm not a doctor." But somehow...

That Consumer Financial Protection Agency is supposed to regulate non-bank lenders, which is why there was all the clamor over Obama doing that recess appointment.

[–]sodhi 2 points3 points ago

sorry, this has been archived and can no longer be voted on

Stuff like this makes me happy to be living in Denmark. A contract such as this would almost certainly never hold up in a danish court of law. It'd be deemed invalid on the basis of being unreasonable. Not depending on whether or not a bank had made this deal.

[–]coldfusion079 4 points5 points ago

[–]Raspry 0 points1 point ago

Do you not have "SMS-Lån" in Denmark? In Sweden that's pretty much the equivalent of thse kind of loans.

[–]sodhi 1 point2 points ago

sorry, this has been archived and can no longer be voted on

We do have SMS Loans in Denmark, yes. However, if you pull that top slider to 30.000 kr. and the bottom one to 72 mdr., you'll see that the "Tilbagebetaling" is 54.331 kr. That's ~180% pay-back. A hefty fee, sure, but compared to the ad posted here, it's nothing (180% vs 800%). Are the Swedish SMS loans that much worse?

[–]Raspry 1 point2 points ago

sorry, this has been archived and can no longer be voted on

Not much worse but the worst one I've seen was 200%. I know a guy that placed himself so much in debt he resorted to SMS loans and he's now 1,5 million SEK in debt. He recently had his "Skuldsanering" approved so for the next five years he's only going to be able to afford the bare necessities.

[–]sodhi 1 point2 points ago

sorry, this has been archived and can no longer be voted on

Yeah, it's perfectly possible to dig yourself a hole, even in a protective system such as the danish as well. However, had we not had these protective laws, I'm sure the amount of people in the pit would be much larger than it is now. Do you not have laws on usury in Sweden?

[–]Raspry 0 points1 point ago*

sorry, this has been archived and can no longer be voted on

We do indeed have usury laws and SMS Loans have been subject to these laws and as a result the loans you see now have a much lower interest than they used to, but during the dawn of the sms loaning 200% interest wasn't unusual.

I looked it up and the highest rate on a SMS-loan in Sweden was 75 862%

[–]T-Luv 15 points16 points ago

sorry, this has been archived and can no longer be voted on

Why should these lenders be regulated? They're creating jobs by putting people in so much debt they'll spend the rest of their lives working to pay it off.

Native American reservations are not "America." They're independent nations that have their own laws.

They're probably the only nations not subject to American influence.

[–]peachGobbler 1 point2 points ago

sorry, this has been archived and can no longer be voted on

I believe we limit the maximum APR to well under 116% in America. Maybe 27%, I think it changed with some Obama-era legislation but I'm not going to Google it. This is a loan offered by a Native American company which does not have to abide by this US law. Businesses on Native American reservations have somewhat different laws (I am by no means an expert on them!) which is the only reason this is legal.

The differences in the way the law applies on reservations is why there are so many indian casinos. It's not that Native Americans are inherently better at running casinos!

That's amateur hour. They should borrow from Wonga.com and get the low, low APR of 4212% (seriously).

Although I suppose if I borrowed from the guys in OP's post at 116%, and loaned to Wonga at (let's say) 2000%, everybody wins! Except Wonga's customers, of course.

[–]hobes88 1 point2 points ago

sorry, this has been archived and can no longer be voted on

dont wonga just do very short term loans?

[–]Robotochan 1 point2 points ago

sorry, this has been archived and can no longer be voted on

Yep.

If you pay it back on time, the interest is fairly minimal compared to the stress of urgently needing the money.

Its when you can't pay back because they don't do any checks, or when they tell you to hold off paying back..

[–]tom56 1 point2 points ago*

sorry, this has been archived and can no longer be voted on

Actually, even for a short-term loan the interest is pretty high (around 50% over a month). But it's cheaper than an unauthorised overdraft and getting stung £20 for "admin". The smarter option is to go to your bank for an authorised overdraft or do the spending on a credit card. If neither of those are available to you, go to your local credit union. Credit unions are legally obliged to charge no more than 26.8% APR (2% over a month). Legalised loan sharks like Wonga are NEVER the best option.

[–]AtomicSamuraiCyborg 0 points1 point ago

sorry, this has been archived and can no longer be voted on

But this relies on being an educated consumer with access to credit unions. If you're smart enough for that, one hopes you weren't foolish enough to be entrapped by loan sharks with cheap tv commercials.

[–]PrometheusTitan 0 points1 point ago

sorry, this has been archived and can no longer be voted on

[–]webchimp32 27 points28 points ago

Pfft, that's nothing. Wonga.com recently got itself in a shitstorm in the UK for recommending students get a loan with them instead of the Student Loan company. Then instead of paying a few percent interest they could pay up to 4,000% APR.

[–]acey365 4 points5 points ago

Here in CT Native Americans have long since known how to play the game. We are home to Foxwods (one of the biggest casinos in the world) and Mohegan Sun (2nd biggest in the US) casinos. Those injuns have been doing quite well enough for themselves up here in the Northeast.

I know a lot of Indians who live on the reservation for Pechanga. The casino may know what to do with it's money, but the normal people don't. Lots of shacks, drugs and other stuff there. In keeping with the OPs pic though, they all seem to be greedy and feel they deserve everything, so that doesn't surprise me with the repayment amount.

Not saying all are like that, but a LARGE majority of the ones I know feel that way. It kind of disgusts me.

I have to say this. Two nights ago, my mom heard her say, "Yes, the money is expensive, but it's a lot cheaper than a payday loan." So she paused to see how much, and we ended up on this exact screen. I mean, what are the odds?

[–]bruint 0 points1 point ago

A friend of mine used to work in one of these "High Interest" loan companies, they got 3 payslips from them and then set up the automatic debit to recur on the same day that they got paid.

Money went in, money came out.

It was a pretty good idea really.

There's tons of math illiteracy in the United States. We look at this and see "Holy fuck that's a shitty deal." But we are not the target consumers. People who have no mathematical background and have no idea how much they're being ripped off are.

What are they gonna do?

[–]AtomicSamuraiCyborg 0 points1 point ago

Operating on a reservation is the only way they can charge 116.73% most states limit you to ~25%... on reservations they aren't subject to state laws.
