there is a lot of coverage in RI here about that. apparently the woman was a complete slob in the casino. surveillance video shows she slapped a guy across the face in the bar and overall just being drunk. its not right to hit anyone, but the cop has an unfair advantage.

from what i've read, the cop had previous assault charges against him, but he's continued to work

If you are dealing with a violent suspect, you shouldn't stand within striking distance unless you need too. She's was clearly violent (that's why police we called in), she was restrained, and the officer was never in real jeopardy. This a case were a cop has poor impulse control issues and poor judgement. He should either be given a desk job or fired, but this crap isn't justifiable.

That is assuming she is in her right mind, she might be mentally ill or otherwise impaired.

The police were called because she was violent, they don't know if she's just a criminal or suffering from a condition. They had her in custody and assumed responsibility, at no time is kicking someone who is unarmed, handcuffed and on the ground acceptable.

Assaulting a police officer is a bad idea because they can and will charge you, but citizens should never expect a beat down from a police officer. I know that isn't currently the reality, but we need to change this.

A kick to the head is always a big deal. No questions asked. Handcuffed with no defense is worse.

The proper retaliation to that (granted taking the high road and not retaliating would be a bit much to ask) would be a decent kick to the thigh, just enough for a solid Charlie-horse and a "don't try that again" message.

A cop should be able to determine when a kick to the face is and isn't appropriate. They should be able to control their anger. They should NOT over react and possibly permanently injure someone that isn't a threat to them and is already restrained.

I agree that what she did was dumb. But I don't get all the people in the comments patting the guy on the back.

He is entitled to defend himself, not seek retribution.

Protocol is to hog tie her with the shackles in the trunk of his cruiser and put her in the back seat of the car and deal with her at the station when all is said and done. Instead, he acts like a petty child - "you kicked me so I'll kick you."

Her kick was an awkward action, hardly a serious threat. A law officer should be able to discern the severity of an "attack" and act proportionately. Even in a more serious situation, a kick to the head is not how you defuse a threat... It would only be appropriate if you had no alternatives, of which he had plenty.

That might cut it on the playground but does not cut it with me and what I demand from a law enforcement officer.

Anyone saying what he did was okay is an ignorant ass.

Ratified. I'm sure he knew the right thing to do, it had to be in his training somewhere. But along the way he learned that he doesn't have to do things the right way... He can do it his way or follow whatever culture of impropriety that exists in his department.

It isn't like she racked him in the nuts, where you have an instinct to defend yourself at all costs. He got a feeble kick to the shin. Didn't even faze him. He just kicked her because that was how he rolls.

I Agree. I think the main issue is people that want to be cops want the power more than they want to help the people they serve, or they can't handle the power they have been given. That being said we do tend to hear about the evil, and not all the good that is out there and there is many cops that have what it takes.

Almost every time some big stir is made about police brutality I end up defending that "you've gotta do what you've gotta do", but this was a completely uncalled for attack. The woman was tied up, laid on the pavement, probably drunk and not in any position for a fight.

A kick to the head is a very dangerous thing, especially compared to her drunken aimlessly flailing, pathetic excuse for a kick to the calf.

Yes, trying to kick the cop was stupid, but shouldn't we ask ourselves how we want our cops to behave? He was not in danger. He was not hurt. He could have taken one step backwards and been done with it. His action was retaliatory and of unequal measure at that.

Lastly, even if we think it was warranted, why celebrate it? A handcuffed citizen got kicked in the fucking head by a cop. It sucks.

We don't know the context of the situation. I'm assuming she was being generally belligerent and uncooperative, which cops (rightly) perceive as dangerous.

The cop's "kick" was also not excessive, because he only used the amount of force necessary to diffuse the potentially dangerous person. He did not continue to hit or kick her, which would have been excessive.

knee-jerk reaction. surprise attacks generate instinctive retaliation. if he knew it was coming, he probably would've reacted with a more considered method, but an attack coming out of the blue like that would make anyone twitchy & aggressive. maybe cops should be subjected to surprise attack scenarios in the office, so they can temper their reactions. like surprise trust falls, but more painful and amusing.

Just so we're clear, if this cop wanted to "follow protocol" in his response to that, he could have done way more damage. He could pick her up, as she resists and fights back, he can take her down, essentially tackling her on her face with her hands still cuffed, cuffed her feet, hog-tied and carried in a way that can cause serious injuries. Instead, she may have a concussion and will wake up with few injuries. Sure, the cop didn't follow procedure, but the woman could have very easily benefited from his response. Plus, fuck that dumb asshole for fighting with people even when handcuffed.

i love how there's all this cop hate here. Sure what he did was wrong.. when you look at the 3 seconds of context that this clip gives...

where's the back story? was she unruly before? did she assault the police while being taken under custody? was she warned to stop or physical harm will come to her? what was her mental state?

obviously none of the answers to the above questions make it right; but to jump to the conclusion that this cop is so horrible with only seeing 3 seconds of video and not have the full story is reactionary at best. every circumstance is driven by previous circumstances. they may not make it right for a cop to dole out justice, but maybe, just maybe they excuse his actions cause she pushed too far and too often...

This is really simple.

Is kicking someone in the head illegal? Yes.

Why? Because it's dangerous. Head injuries are serious.

The police have a responsibly to protect themselves. To enforce the law and observe police procedure. This guy did none.

Depending what state or country you are in. There are court cases where connecting a foot to a head is assault. Or assault and battery. Whatever.

Even slight head injuries can lead to death or brain injury so most states are working to stem this type of violence.

It really all depends where you live and what the law says. But it's all moving in that direction

I really doubt you want to live in a world where police are allowed to kick someone in the head.

We grant the state power. The police have a monopoly on violence. Only the police(Or the state) is allowed to exact force on the bodies of citizens.

With that power come the burden of truth. They must support their actions with evidence.
