I'm really annoyed that this keeps getting recirculated. The CEO cooperated with authorities and helped to convict the primary culprit, Lee Farkas, who was sentenced to 30 years. The homeless guy, if I'm not mistaken, already had a significant criminal record, and it was first degree robbery, meaning he either had or implied he had a deadly weapon and intent to use it. There's obviously more to it, and maybe there's something that could be said for the homeless man "turning" himself in, but as is, this is grossly misrepresented and doesn't do anything to prove something about the disparity between the rich and the poor.

He could've gotten between 3 and 40 years. Still, it would've been nice for the judge to give him closer to 3 given the circumstances.

I agree with that. He regretted what he did and turned himself in, so why not be merciful with him?

From the unsourced anecdotes floating through my head, i remember a prison dude telling me that cultural groups will band together and rape members of the same race, but not other races. This was used as justification for neo nazi groups in jail, a way of not getting raped quite as much.

The sentencing disparity is due to the nature of the crime (fraud vs first degree robbery) not the amount stolen.

This is more than likely due to a prior record.

Fraud carries a 5 year Prison sentence. A lenient judge could easily sentence 40 months Jail. (Prison time is never expressed in terms of months, and generally is expressed as a range {zero to X}).

Whereas the guy getting 15 for robbery likely had a prior record. If a gun was used then he got the federal mandatory sentence plus additional time for his criminal history.

The reality of the justice system is terrible. There is also a reality that this homeless man is now being fed 3 meals a day and has a climate controlled room to sleep in a bed with showers, toothbrushes, and soap.

Yes, there's one form of justice for the rich and one for the poor, no one in their right mind is going to argue with that and yes this man's long sentence may have a lot to do with his race and class but, let's not forget that in the course of the robbery he led the bank staff to believe that he was armed and caused them fear and distress, so it's not just about $100.
