I once parked my Vespa (back center, like I was taught) in a parking spot because the place I was visiting had no bike racks.

An hour later, I come out and my scooter is thrown on its side on the sidewalk, half into the bushes. There were dents and white paint on my bright red bike and bright red paint on the bumper of the shitty white car now parked where my bike was.

I took photos and a license plate number to the cops the next day and they did exactly shit. My insurance covered it, but my poor bike was totaled.

The same thing happened here, somewhat. A neighbour across the street always parks in her driveway, and my car was on the road. All of a sudden my car is covered in green paint and scratches, and her car is in her garage. Her car hadn't been in their since we moved in. We do nothing, and wait until her car is out, and my dad notices the paint on her car. Confronts her and of course she denies it, so we called the police. The cop basically said "I am 100% sure she hit your car, as clearly the paint is there, but I'm sorry there's nothing I can do about it" Uhh thanks.

I have a similar story but with an opposite outcome. I was at a friend's house and my van was parked in the street while we played Battlefield 2142 all night. At around 3am we hear a bang outside but think nothing of it. When I woke up I went out to my van and it was just demolished, someone slammed in to it hard and it was completely undriveable. There was a side mirror and some trim lying next to my van's corpse that didn't belong to me, so me and my friend hopped in his car to cruise the neighborhood and see if we could spot a car missing this mirror. A block away we found a car that had obviously been in a wreck and the mirror was missing, so I took pictures of the car, license plate, house, etc. and called the cops. They found the guy and he went to court. The prosecutor ended up revoking his license and gave him jail time because he admitted to driving drunk on a suspended license. It all depends on how you pursue it, and getting a lawyer and taking the other guy to court can help.

TLDR: If all else fails, call Judge Judy.

Cops need a different level of proof.

Pictures of damage between two cars that line up will definitely work in a civil court. It is really up to the cop if he wants to do anything or not.

It isn't the cop's job to determine fault, but it is his job to write an accident report. Get a copy of that report, plus all your pictures (and maybe another witness during the accident report and picture-taking) and go to small claims court. This is exactly the kind of thing it was created for.

In many communities the police are not supposed to take reports on accidents that are below a certain $ value of damage. I think it is 5k here.

In those situations though, they are still obligated to ensure that the exchange of insurance information is accomplished (I am not a lawyer, and I do not know this to be a legal requirement, don't get me wrong. it is 100% done here though in every instance). Was that not offered?

Yes, to potentially get money or insurance info out of her, it may take small claims court, but traffic law would allow the officer to give the woman some sort of citation (fleeing scene of an accident for one; yes, it was an accident as the victim's car was on the road). Also, the cop writing out even some sort of accident report would help with getting money out of the other lady's insurance company a little easier.

It's not enough probable cause to charge the other person. They could have hit ANOTHER car the exact same color as yours, and you could have been hit by another green car. Prove that statement wrong.

Should have gotten him to write up the report, taken LOTS of pictures, then filed a civil claim.

It's not the cops' job to prove it one way or another, that is the court's job. The cops collect evidence: for instance pictures, dent location, paint samples, etc.

I'm sure, at great cost, this case could have in fact have been proven using forensic analysis of the paint. More than the repairs would cost probably.

It would just be nice if that cop had written up a report so that person would have it on her record, especially if she does this often.

Similar story. My brother comes out to the parking lot to see a huge dent in his truck, paint chipped off, etc. The white car next to him has a dent in end of the door, red paint from the truck all over the edge of it. They had hit his truck hard enough to dent their own door. He took pictures, called the police, and they did nothing. Took a report, gave him a claim number to file with his insurance.

As it turned out, it was a friend of mine, who had tripped, and fallen out of the car drunk - this was the passenger side of their car. I found out from her, the police wouldn't give us any information as to who owned the car so we could file a report with small claims.

Since then, I carry a hammer. Since the police won't handle parking lot justice, I will.

is the concept of insurance unclear? you take the pictures to your insurance company, and they take the case to civil court suing the person to recoup their costs. Did you expect that the cop would arrest that person for damaging your car?

You get your insurance to pay for your damages, give them all information, pictures and evidence. Then they sue to recover. It's that simple.

Sucks dude... I hate people. Some douche ran me off the road 2 weeks ago in Dallas. He merged into me, I honked like a mother fucker, he kept coming, I kicked the ever loving shit out of his driver door, he kept coming, ran me straight into a curb. He saw me at the last minute, but it was too late. I was over the bars, and on my neck at that point. Mother fucker kept on driving. I know I left a massive dent in his door, but I wasn't able to get the make/model of the car. Only the color. Since then I've learned that it is a common occurrence in that neighborhood as everyone is a rich fucktard who is constantly glued to their cell phone. Won't be going back over there...

Cops don't give a flying fuck about stuff like that. My ex's brand new car was sideswiped by a hit and run driver, she chased him across the city and called the cops and gave them his license plate and description. The cops did exactly one thing: told her to stop chasing him. Never followed up on the complaint. Never arrested him even though they knew exactly where he lived. Nothing.

Same thing when my gf's house was broken into.

But you can bet your ball sack they will put their boot to your neck if you speed.

Exactly this! We got some guy breaking into my car on CAMERA (We set cameras up as this wasn't the first time). After I gave them the video evidence, they called back and said they can't determine if the guy broke our window and snagged a couple of things. Even though it clearly shows him standing next to the car for a extended period of time and trying to reach into the broken window.

And just yesterday, this LEO was hauling ass to catch me and I got a speeding ticket going 40 mph in a 35 mph zone... Just had to vent a bit, carry on.

This is why I just find a post or something on the sidewalk and chain my scooter to that. Also the Kryptonite New York chains are the shit even if they cost a fortune. Nobody is getting that off without 15-20 minutes and an angle grinder. Nothing is theft-proof but by being the least attractive target I've found people generally leave my bike alone these days.

The main reason we have designated motorcycle spots is people like to cruise into a parking spot at high speeds and at the last second don't realize a motorcycle is there and plow into it. It's happened to my motorcycle a few too many times. We don't park them in places where you see them to be dicks, it's so the crazy driver won't blindly smash into them.

That's not how it works in my country, and judging by the shape of the license plate that's probably this one.

That said, any corresponding damage to the truck would pretty much prove guilt.

What I would be much more worried about is the offender simply walking the bike out into the middle of the road. Most bikes don't fully immobilize when parked.

Our Mall has "frequent shopper" spots that you can get if you sign up for it online. One day my Mom was with me and she is handicapped and all the handicapped spots were taken. So I parked in the "frequent shopper" spot and this guy flipped out saying "I'm a frequent shopper, get out of my spot!" I laughed, told him to pound sand and to have a good God damn day. I came out to cops by my car and they said "You can't park here." I asked if I was getting towed or a ticket and they said no. This sounds like a myth. Plenty of people get citations on private property, otherwise no one would ever get an MIP.

If they have the permission of the owner, I would think they most definitely can.

They can give tickets for laws that are breakable anywhere, but not for laws enforceable only on govt property - like traffic or parking tickets. For example, you can blast through stop signs and speed in your mall parking lot all fucking day but if you shoplift from the mall and get caught, you've still got problems.

Security for a gated community probably falls under some kind of home owner's agreement that your friend signed as part of the purchase of their house. My bet would be they cannot legally fine you as a non-resident but they would use something else such as trespassing.

I have always operated under the assumption that a college parking fine can only keep you from graduating (so you'd have to be a student to care). I don't know if they can send you to collections or not.

Depends on the community. My parents don't live in a "gated" community, but they live in a "private" one in that the HOA owns all the roads and such, and they have their own police force. They used to only be able to give traffic tickets on the roads, but now they have been deputized by the county sheriff's department strictly for the community and the small stretch of shops and such just outside. It's got about 15,000 people though, so it kinda makes sense to have real police.

I'm a biker, and shit like this makes my blood boil. Considerate parking is such an easy thing to do. I would have done the same thing as the guy in this picture, but in order not to have my bike fucked up, i'd have left a note in the window saying something like this,,,

"Hello! I'm the owner of the bike which is currently parked behind this shitty park-job of yours. Here's my number, give me a call when you're ready to apologise and i'll come and move my wheels."

Honest question... they don't have motorcycle parking where I live. What is the point of them? If a car parks in the motorcycle parking, shouldn't you just go and park in the spot that he would have parked in? Then when you park, you just take up half the space and another motorcycle can share the spot with you. That's what we do around here at least.

I understand things like handicapped parking and visitor parking, but I don't see why spots need to be marked specifically for motorcycles.

a Motorcycle parking area that is the size of 1.5 normal parking spots can fit 5-6 bikes into it. Thats 5-6 extra spots out in the rest of the parking lot that aren't being monopolized for a single motorcycle and now the cagers can use. It is a win-win. Blocking the motorcycle spots fucks the system up for everyone involved except for the asshole who couldn't be bothered to look for a normal spot.

In Glenelg, Australia (near the beach, busy spot) they were planning to get rid of the motorcycle parking. So the local club got a few of us down there to park our motorcycles in individual car parks for a few hours on a Saturday afternoon.

It certainly got the point across as the idea was scrapped.

I can't speak for every area, but in the UK they're often in high-traffic areas, and in plain sight. It just acts as a theft deterrent if they're constantly in view, as opposed to being tucked around the back of a building behind a skip.

Secondly, they're often at the end of row, or in a corner spot so that a steel railing can be placed next to it for bikes to be chained to. This is a pretty good example of that.

Thing is, if they've been designated motorcycle parking, people should just fucking respect it, just the same as they do for disabled and parent & child spots. The example by the OP is just a case of laziness/selfishness and these people should be called out for it. Much the same as the people who occupy two, or ever four spaces because they're scared of getting their car scratched.

They help keep the bikes safe from drivers hitting them. A bike in a normal parking lot is harder to spot when pulling into the spot. Now imagine a crowded mall area with crazy american drivers. I've had my bike hit this way before, which makes me also EXTREMELY frustrated when I see a car in the motorcycle spots. Winter time with 4 inches of snow, fine, anytime else, MOVE YOUR SHIT.

Most (if not all) hospitals have a separate "ER Parking Lot" that, short of a catastrophe, has plenty of parking spaces for the size of the ER. There is no excuse for parking like an asshole other than being an asshole, or being too lazy to look for an actual space you're allowed to park in.

Most of the hospitals around here actually have valet parking for the ER (for the vehicle the patient is in) for this reason. Anyone else has to find a spot somewhere else, but there's a special gated parking lot so you don't have to worry about a parking space when your kid is bleeding from every orifice.

Someone does not deserve to have their car keyed for parking in the wrong space. Maybe their mind was preoccupied with something very important (like the illness of a family member, relationship problems, or job problems), or maybe they just screwed up. I used to ride a bike. Once whilst working a scooter blocked a one way street, we lifted it and hid it behind a skip and moved on. Don't know if they guy ever found it. I love bikes, but just cos there's a dick in your way doesn't mean you have to lower yourself to his level.
