What makes it even more hilarious is that the cheesy "numerology" guy is the one who went the extra mile and actually put the 1 on the shoulder. ESPN didnt.

The person/organization taking the photograph has the rights to it. The NFL has rights to all logos etc, so you can't publish those without the explicit permission, but that doesn't mean that they can assign rights to others if they don't own the rights to the image.

Dealing with photography rights is a pain in the ass.

I almost guarantee whoever made it did it as a small joke. I worked in the news and one of the editors put a star wipe as a transition. We all got a laugh out of it because the common viewer would never notice. I suspect a similar thing went on here.

Kind of? The other options would have been scouring their media for a pic of Manning that actually fit the visual scheme they'd chosen, or failing that, create a new scheme suited to the pics of these two that they DO have on file. This could have been a lot easier than either of those options.

I don't know, it kind of seems if you are a large 24 hour sports news organization, you might have a file of promo/game photos of the most prominent, most covered players of popular sports. Especially one that will likely be involved in more then one storyline for games covered this year.

Seems like you would just look through your Manning and your The Devil photo files and find 2 that went together and build your scheme around that.

If you built your scheme first and then tried to find resourced to fill them, well, it seems less efficient. Like if you bought a large couch for your house before you measured to see if it would fit... oh well, who doesn't like 2 rough cut love seats?

It probably has to do with photo rights. The Brady photo is from 2009 (he is wearing the Pats 50th Season patch) so they likely didn't have (or found it hard/too expensive to find/use) rights to a photo with Manning in a Broncos uniform.

If you google image search "Broncos Manning" this picture shows up at the top. It's the same photoshop but with the correct number on the sleeve and the article it appears in is from last May. What is going on? Did someone at ESPN take this image off of google and remove the one on the sleeve?

Remember, fair use is a DEFENSE to infringement. In other words, the burden is on you to prove fair use.

When you have an entity like ESPN who is using the picture for profit and the picture is not used to actually tell a news report, the protection is less powerful.

That's why ESPN will purchase pictures from the NFL or AP instead of just pulling the picture for free.

They would have more protection if, for example, they were using a picture from a game that just happened and they are reporting on what happened. But that's not the case here.

Every news outlet has to get permission to use any media content (i.e. photos or videos) from the original artist. In other words they can't just conduct a quick Google search like the rest of us can. My guess is whoever shopped this photo gave the rights to a bunch of different outlets (evident by the fact that this pic shows up in multiple sources not just ESPN) and ESPN had it in their useable database.

Why would they do this as opposed to just using a new picture? You know, like the thousands that have been taken of Manning this season. Maybe they wanted a specific pose, but still this is harder to do than find a picture.

Wait, is it possible someone else did the Photoshop and ESPN stole their edit without realizing it wasn't an original? Or maybe the picture was made pre-training camp and ESPN had it in their archives as a "what would Manning look like" type photo.

Thing is that the big boys out there need to pay for their images and their editorial use.

Example.

So in reality they were probably just trying to save a few bucks by splicing together an old image that they owned the rights to.

Technically they are not allowed to just grab an image off Google.
